Credit Card Surcharging Rules & Regulations
What is a surcharge?
A surcharge is a small fee added to a customer's invoice when they choose pay with a credit card. It is designed to offset the cost of credit card processing fees charged by the card networks and issuing banks.
By applying a surcharge, businesses can recover some of the costs however, card networks and federal/state laws tightly regulate how surcharges can be applied.
What are the rules and regulations for surcharging?
Each card network and state has their own set of regulations. Floorzap's surcharge feature is designed to make this simple and compliant - automatically applying surcharges where allowed, and never where prohibited by card network or legal rules.
- Only applicable to credit card transactions; debit cards and ACH transactions cannot be surcharged.
- Cannot exceed the cost of acceptance.
- Cannot exceed 3%.
- Must be the same percentage across all card brands (Visa, Mastercard, etc.)
- The surcharge amount must be identified separately on the invoice.
- Cannot disable debit transactions while continuing to accept credit transactions.
These rules were taken into consideration for the surcharge feature to help protect our customers from violations or penalties associated with surcharge non-compliance. While Floorzap supports credit card surcharging, we do not support applying convenience fees to debit card and ACH transactions.
